Mass surveillance: can our secret services spy transparently, and not too much or too little?

Can a newspaper editor in societies in which military service largely belongs to the past grasp the importance of protecting military secrets? We mean, understand this viscerally – at gut-level – like any child who ever had to ask, ‘But what if Daddy doesn’t come home?’. We mean, return from a war; any child ever comforted by assurances that ‘Our spies are better than their spies,’ – the mysterious and murky specialists in warning about the likely direction from which gunfire and bombs could come; the places where land mines might be buried and assassins or submarines lurk.

The question marks have only been multiplying as we have wondered why the media-stoked outrage over the thumping-great scale of government surveillance is not matched by shock and anger about vast apparatuses of commercial surveillance. Life without Google would be as frightful a prospect for post-Gutenberg as for anyone else. Still, we ask with furrowed brow, why are people incandescent with rage about spooks, but paying no attention to — for instance — the news on the Extreme Tech site last month that Microsoft and Google are working on ‘super cookies [that] will track you wherever you go, and whatever you do, whether it’s on your smartphone, PC, game console, or even TV.’ Or, this quotation of an expert in The Wall Street Journal in September:

“It’s a persistent identifier, a super cookie,” says Jeff Chester, head of the Center for Digital Democracy. “Google will gain more information about users wherever they are, across platforms and with one number. This will be the new way they identify you 24/7.”

Why are only some of us apparently willing to give the motives of those entrusted exclusively with our protection the benefit of the doubt, the way everyone else does commercial surveillance that is done exclusively for profit?

John le Carré, one of our heroes, told his North London neighbour Philippe Sands that ‘all of us have an aunt in the secret service.’ Of course he was being witty. But some of us in this conversation who grew up as disgusted by the cover-ups in the Vietnam War as our contemporaries, everywhere, are also members of a minority caught up in childhood in small, regional wars, or who had parents who served in peacekeeping forces in war zones. That makes for a different sort of anti-authoritarian perspective. Press contributions to and coverage of the surveillance debate strike us as surreal.

Because information is the common stock-in-trade for spies and journalists,  The Guardian and its partners in publishing the massive, continuing Snowden leaks of military secrets have been engaged in an extraordinary flexing of power. We have been transfixed by the sight of them not merely criticising but punishing their governments in kind for the comprehensive surveillance of civilians that they deem entirely wrong – without judge, jury, or any public consultation about this conclusion. Those rotten spooks  overstepped the limits of decency in stealing our private information, did they? Fine, let’s rip the covers off their private information and broadcast it to the world!

Punishment to fit alleged or actual government misdeeds is not typically an option for newspapers. For a parallel, consider that in 2009, when The Daily Telegraph followed up on a freelance journalist’s discoveries about British members of parliament writing off the costs of second homes and cleaning castle moats as ‘expenses’ passed on to taxpayers, that newspaper could hardly chastise parliamentary paymasters and expenses-checkers by flinging millions of pound notes into the Thames, or publicising passwords to bank accounts for the public purse. A San Francisco paper lambasting California’s state government for inhumane overcrowding in prisons cannot lock the governor and his aides into scorching and stinking penitentiary cells for a week to make its point.

The scale of the leaks is staggering. ‘In early 2013,’ the Wikipedia records, ‘Edward Snowden handed over 15,000 – 20,000 top secret documents to various media outlets.’ We have yet to see as much as a hint in The Guardian — the  standard-bearer for the fight against government spying on citizens – that the whistle-blower might have been a touch excessive, or, as Charles Dickens put it in a different context, shown a lack of ‘that faculty of extracting the essence from a heap of statements which is among the most striking and necessary of the advocate’s accomplishments.’

Snowden’s objective seems clearly to have been not merely to reveal but wound – and The Guardian and its co-publishers apparently went along with that, as it largely did with Julian Assange’s Wikileaks, because of a cultural shift analysed in the one deeply informative and scrupulously balanced evaluation of the mass surveillance crisis we have read so far. Writing in the journal National Affairs, Gabriel Schoenfeld suggests:

The new willingness, even eagerness, of journalists to publish such sensitive information stems first and foremost from two cultural developments … The first is the increasing prevalence of the libertarian notion — with adherents on both the left and right, and in both journalism and the federal bureaucracy — that “information should be free.” This ideology leaves room for almost no rationale for secrecy in government and is deeply skeptical of and angered by post-9/11 government surveillance practices.

The second development is the changing nature of the news business, with its fierce competition and intense pressure to be first to break a story. In deciding whether to publish leaked secrets in the face of government warnings to desist, news organizations seem to operate according to a logic reminiscent of Cold War nuclear strategy: If we don’t strike, one of our competitors will …

The Guardian, widely known to be fighting for its economic survival, has been frantic to triumph in this evolution of competition. Make no mistake, post-Gutenberg is as disturbed as anyone else by the implications of governments tracking everything we do, say and even think. But both The Guardian’s framing of the problem — through its barrage of reports about and opinion pieces on it – and its chief conclusion about it have serious flaws:

 The newspaper’s coverage is unbalanced in the extreme degree – and proudly. Its editor, Alan Rusbridger proclaims his preference for partisan journalism in the latest issue of The New York Review of Books

The Guardian itself inhabits an editorial space that is quite distinct from most American newspapers. British papers have grown up with less reverence for the notions of objectivity and detachment that can, rightly or wrongly, preoccupy some of our American colleagues.

How can anyone trust the information in a newspaper draping itself in a banner like that?

• Proud partisanship explains why Guardian readers have not – as far as we know – been given  much, if anything, in the way of objective context and historical background for government spying. Without that, how can the paper claim to be fostering the intelligent public debate about mass surveillance supposedly its chief motive for the Snowden leaks?

Espionage policy-makers and administrators have been permitted only a series of robotic and too-predictable sound bytes to explain their reasoning and actions in the technically dazzling transmedia production on this theme offered on the Guardian website. In The Black Swan (2007), a clever polemic widely read among the intelligentsia, Nassim Taleb mentions his surprise at meeting US top brass, ‘military people’ who ‘thought, behaved and acted like philosophers,’ only more so and far more imaginatively than professional philosophers, and ‘without fear of introspection’. Why are people of this calibre not invited to defend government surveillance in Guardian reportage or op-ed contributions?

• Like virtually every other print media publication, The Guardian is hardly realistic in proposing that the solution to excessive surveillance is greater transparency in the running of intelligence-gathering, and stringent oversight. There must be something wrong with us at post-Gutenberg, because we see see-through spying and spy-runners as a prospect as likely as scholarly, library-haunting footballers.

How strange that closer oversight has also been recommended for the media in the wake of the phone hacking scandals and the Leveson Inquiry into press practices and ethics. Better supervision for both spies and journalists would mean, as a first step, requiring them to be guided less by judgment and instinct, as they often are at present, than by a set of precisely defined rules.

Would it be any easier to agree on such rules for spies than for journalists? In his testimony at the Leveson hearings, The Guardian’s freelance contributor Nick Davies – the star reporter who exposed tabloid phone hacking and was also a driving force behind the publication of the Julian Assange leaks – described the difficulty of deciding precisely what reporting is and isn’t in the public interest:

We had a huge problem with the Wikileaks stuff. […] I went off and persuaded Julian Assange to give all this material to The Guardian and The New York Times and Der Spiegel, and it rapidly became apparent that that material contained information which could get people on the ground in Afghanistan seriously hurt. They were implicit[ly] identified as sources of information for the coalition forces.

I raised this with Julian very early on and he said, “If an Afghan civilian gives information to Coalition forces, they deserve to die. They are informers. They are collaborators.” And there were huge tussles between the journalists and him — actually, maybe this isn’t a terrible good example because I would say emphatically it’s absolutely clear that we couldn’t publish that information and didn’t, but he did.

Any government trying to direct newspapers in such decisions – or demand that they debate their ins and outs ‘transparently,’ in public — would be accused of interfering with the traditional freedom of the press, if not behaving like a police state. In the continuing battle in Britain over press regulation, as Chris Huhne noted in The Guardian, this week, …

According to the newspapers, self-regulation failed in securities trading, banking, construction and many other fields. But it works brilliantly in just one area: newspapers. This inconsistency is ludicrously implausible.

In the US, Joshua Foust recently recorded on his blog the appearance of new journalistic techniques in reporting national-security stories. The evidence for this is limited because, as one Washington Post reporter recently explained, there is “a widespread practice in the media industry of declining comment on reportorial methods.”

Yet the media are howling that spies should be required to reveal their methods and tricks. … Should The Guardian and other media campaigners calling for tight constraints on and supervision of government spying on the populace make a less ambitious demand — to perhaps simply hold the spooks to account more rigorously for their mistakes and infractions?

It will be a happy day when some widely-read British or American newspaper stops merely shouting about the horrors of mass surveillance by the government – as opposed to Google and Microsoft – for extended, intelligent explorations of the  ‘other side’ of the argument.

After the horror of thought police, the most terrifying aspect of the society George Orwell anticipates so brilliantly in 1984 is that almost nothing about its regulations or the behaviour of the people running it makes any sense.

Why was The Guardian so unembarrassed by the inconsistency of making such a fuss about being forbidden by Government Communications Headquarters (GCHQ) to publish any more revelations about the extent of UK and US government spying on the public – when this newspaper also shuts down disclosures about and discussion of matters it considers sensitive?

For instance – what? For instance, reader commentary on the Leveson Inquiry into press ethics and conduct. As more than one commenter pointed out, on the same web page as the newspaper’s unconvincing attempt to justify its censorship, Lord Justice Leveson himself had been permitting far more revealing accusations and evidence to be aired at his hearings. guardian notice Complaint by Guardian editor Alan Rusbridger:

The mood toughened just over a month ago, when I received a phone call from the centre of government telling me: “You’ve had your fun. Now we want the stuff back.” There followed further meetings with shadowy Whitehall figures. The demand was the same: hand the Snowden material back or destroy it. I explained that we could not research and report on this subject if we complied with this request. The man from Whitehall looked mystified. “You’ve had your debate. There’s no need to write any more.”

As a reader identified as ‘Dr. Gabriel Mayer’ on the site of The New York Times pointed out, about the tunnel vision in condemnations of surveillance focused exclusively on the National Security Agency:

What really surprises me is this universal alarm regarding the NSA and a possible sinister utilization of data should something unpredictable and Orwellian take place.

If …… and when …

But right now this comment is being monitored by Google and Apple (I am on one of their products) for sure, and probably a few other bloodthirsty corporate entities.

Where are the op-eds about this reality?

Well, Dr. Mayer, how can the newspapers be expected to attack round-the-clock commercial surveillance when they themselves plant spy cookies on our devices every time we read articles on their sites? Looking for a ray of light in this chilling scene, we were pleased, at first, to read a paragraph in David Carr’s Media Equation column in The New York Times last week. He deftly summarised recent leaks by whistle-blowers and other disseminators of vital information outside mainstream journalism:

Because of the leaks and the stories they generated, we have learned that in the name of tracking terrorists, the N.S.A. has been logging phone calls and e-mails for years, recorded the metadata of correspondence between Americans, and in some instances, dived right into the content of e-mails. The WikiLeaks documents revealed that the United States turned a blind eye on the use of torture by our Iraqi allies, and that an airstrike was ordered to cover up the execution of civilians. WikiLeaks also published a video showing a United States Army helicopter opening fire on a group of civilians, including two Reuters journalists.

But then his characterisation of the leakers being punished conveyed an impression of raffish, marginal and faintly unreliable figures:

Perhaps they got what’s coming to them. They knew, or should have known, the risks of revealing information entrusted to them, and decided to proceed. Like almost all whistle-blowers, they are difficult people with complicated motives.

So, too, are the journalists who aid them. It’s not surprising that Julian Assange, the founder of WikiLeaks, who brokered the publishing of Private Manning’s documents, and Glenn Greenwald, the columnist for The Guardian who has led the Snowden revelations, have also come under intense criticism.

But why was there no mention at all, in his column, of possibly the most distinguished leaker of all – a retired four-star general who was vice-chairman of the U.S. Joint Chiefs of Staff? He is generally believed to have been the chief source for the story last year about an American cyber-attack on Iranian nuclear facilities, a report that appeared in … well, The New York Times. A blogger explained:

In the flood of news surrounding Edward Snowden’s revelations about the surveillance operations of the National Security Agency, another equally consequential development in the crisis of the security state has gone largely unnoticed. This is the news that retired general James Cartwright, former vice chair of the Joint Chiefs of Staff, is under investigation by the Justice Department in relation to the leaking of secret information about the 2010 Stuxnet virus attack on Iranian nuclear facilities.

To understand the significance of this, it’s important to observe that, as with the revelations of Edward Snowden and Bradley Manning, this alleged “leak” did not reveal anything that was not known to the enemies of the United States. In all these cases, the leaks only confirmed what any member of the general public who had bothered to follow the story could reasonably infer.

A New York Times article from June 2012, which allegedly relied on leaks from Cartwright, revealed that Stuxnet was part of a U.S. program initiated by the Bush administration and carried on under Obama.

The Kickstarter-kicking has begun: don’t let crowd-funding of pigs-in-pokes ruin the promise of micropayments

This post-Gutenberg blog typically takes the giraffe-necked – that is, very long – view. It hardly expects instant gratification for recommendations about the future of publishing, or suggestions for its evolution. That made it both unsurprising and shocking to find the gist of these cautions about micropayments and crowd-funding prove justified in less than a month:

  • Could crowd-funding art with cash advances amassed from micropayments be less helpful than getting artists decent compensation from micropayments collected for finished work?
  • … [Artists] transferring the balance of cash-gathering sweat to work that has yet to be done is surely a bad idea …
  • There is some danger that disappointment with microfunding could lead to disenchantment with micropayments of every kind. That could delay the shift from conventional ways of selling art (through publishers, galleries and so on) to the liberating alternatives that new technological inventions have begun to bring us.

Only six months ago, Gizmodo, one of the most influential technology-watching sites on the web – it counted Steve Jobs among its avid readers – was raving about the prospects of online fundraising for new projects of every sort, from new-fangled gizmos like iPad stands to artistic schemes, inventions, and gigs. Its enthusiasm was concentrated on Kickstarter, the most prominent go-between for creators and the random collections of small-scale investors contributing to ‘crowd-funding’ creative toil:

Kickstarter is full of awful, ill conceived, downright dumb ideas. So is the internet. So is the universe. But it’s also festooned with crazy-good thinking, ingenuity, and imagination. It’s fun and unfettered.

[…]

Kickstarter is the only viable place any average Jonny Internet can take a decent idea and stand a chance of making it real. No venture capital vampires, no hype …

The recommendations of old print media usually follow in Gizmodo’s wake, but in January, The Economist appeared to boast about leading the applause:

This newspaper has written about Kickstarter several times in the past two years, including an overview of how crowdfunding works after the firm had raised about $15m in its first year. At the time, it was unclear whether such crowdfunding (also called micropatronage) was a passing fad or a rising alternative to conventional starter financing for creative media.

Kickstarter’s performance in 2011 bolsters the latter case.

Though that ancient cosmopolite’s bible did mention the odd disappointment for both fund-seekers and micro-patrons, it has yet to regret its championship of crowd-funding. But for Gizmodo – far more closely in touch with thinking among the twentysomethings who dominate online innovation – it was time for sackcloth and ashes a fortnight ago. In a piece headed, ‘We’re done with Kickstarter,’ Gizmodo explained:

We look at hundreds of products every week. Sometimes thousands. At first all of us were pretty stoked about Kickstarter, because it seemed like a genuine font of unfettered innovation—the hive mind coming up with products that we truly needed but had never even thought of before. And maybe it was. But it’s not anymore. It’s a sea of bad videos, bad renderings, and poorly made prototypes. Some might be good. Many are poorly made. And some are downright fraudulent, taking peoples’ money without delivering the promised rewards. This has happened to me.

[…]

Hopefully Kickstarter will evolve into something a little more trustworthy that we can feel comfortable sharing with you. Because in this game, a source you can’t trust is a source you can’t use.

In comments on its lamentation, readers railed at Gizmodo in posts like this one from @anamnet:

Giz introduced me to Kickstarter and now they are the first who’re sick of it. Makes them sound like a teenage girl who’s getting over a fad.

Actually, Gizmodo deserves to be congratulated for its forthright mea culpa. Next, it would be wonderful to find on that site a piece weighing all the reasons given here for preferring post-production micropayments – especially for artists and writers, starting with this one:

Seeking and accepting money in advance can constrain creativity. Anticipating prospective backers’ anxiety about squandering even small sums on inconsequential, pig-in-a-poke projects, artists are puffing up their planned works and divulging details of visions that have yet to meet the challenge of execution. How much room for creative manoeuvring and play – or simply changing their minds – will they have when, to reward their micro-investors’ trust, they feel that they must treat proposals as promises?

… Gizmodo’s helpful admission about reading the tea leaves incorrectly on crowd-funding is not just admirable in itself but made a salutary contrast, in my week’s reading, with an older publication’s delusion that it  comprehends what readers want in post-Gutenberg publishing. An extract from a mesmerising report in the latest Private Eye:

‘Last weekend we did something extraordinary.’ That was the verdict of Guardian editor Alan Rusbridger on his ‘Open Weekend’ … at which readers descended on the paper’s offices to gawp at [Guardian journalists].

Never mind that the newspaper is losing money galore. The bring-your-readers-to-work idea represented the way forward for ‘Open Journalism’ – apparently something to do with internet clouds, killer apps, crowd-sourcing and trouser-presses.

Many hacks in the building looked on the jamboree with jaundiced eyes […] but were assured that this is the way forward for Journalism 4.0 as the Guardian set off on its exciting transformation from newspaper to online events organiser.

Alas! The ‘new paradigm’ seems no more profitable than the old one. After totting up the figures, Grauniad beancounters have discovered that the self-styled ‘festival of readers and reasonableness’ – attended by 5,000 people paying between  £60 and £70 – made a net loss of £150,000.

Dear Grauniad, your ‘Open Weekend’ is surely the daftest idea anyone has heard for reshaping publishing. No, your sensible readers do not wish to crowd-fund your survival. Nor do they want to pay to peer at your writers, or throw peanuts through the bars of their cages. How about showing some glimmer of grasping what this post-Gutenberg revolution is really all about? Why is The Guardian censoring debate about press reform and ignoring the Lord Chief Justice’s endorsement of citizen journalism?

The Leveson enquiry convened by David Cameron’s government to investigate the British phone hacking scandal and ‘the culture, practices and ethics of the press’  will make recommendations about whether the 4th Estate should be trusted to regulate itself.

Can the public be expected to trust self-regulation when a leading newspaper is going out of its way to obstruct debate about media ownership, and the question of whether the media should be restructured to include non-traditional disseminators of information?

Could this restriction of free expression be related to the omission from press reports of any mention of a clear and ringing  endorsement of ‘citizen journalism’ – and the rest of the 5th Estate – by Britain’s top judge, the Lord Chief Justice, Lord (Igor) Judge, in a speech on press regulation in mid-October? So few newspapers reported the speech at all that I learnt about it from a Twitter feed.

The Guardian, like The Sun, only mentioned what he said about the importance of a free press in a brief news item, leaving readers to find their own way to his careful qualification of that remark in a transcript of the whole speech posted on its site. It failed to draw its readers’ attention to a point he emphasised at the start of his lecture. It was about the tendency of the press to wilfully misread a famous statement in 1762 by the reformer and political activist, John Wilkes, as restricting the right to uncensored expression to the privileged minority that the 4th Estate represents. Justice Judge began by quoting Wilkes, then explained what the agitator meant:

“The liberty of the press is the birthright of a Briton, and is justly esteemed the firmest bulwark of the liberties of this country”. 

We embrace that statement. The significance of what John Wilkes said was not, as those connected with the media sometimes suggest, that the statement is upholding the liberty of the press. That is undoubtedly a direct consequence of what John Wilkes said, but in reality on close examination what he was saying was much more profound. He was asserting that the liberty of the press is the birthright of every citizen, that is, the community as a whole. It is birthright of the citizen that the press should be independent. It is therefore not a right of one section of the community, not just a sectional right. It is the right of the community as a whole. It is, if you like, our right, the right of every citizen.

I cannot believe that The Guardian thinks its moderators should be deleting proposals for a mere experiment in co-owning part of a newspaper site with reader-citizens. But I had no reply after I tweeted the paper’s editor, Alan Rusbridger, an alert about the removal of a comment containing a link to my piece about the pernicious effects of advertising on the presentation of the truth. Earlier messages asking the newspaper’s moderation team for an explanation for the cuts also received no answer. This is puzzling. The editor has been giving speeches about ‘the mutualization’ of his newspaper, announcing that ‘our readers have become part of what we do. . . lending a hand with research and ideas, bringing us up short when we get things wrong.’

An interesting idea, but you can share the same tiny media cubicle, and never discover who your workmate knows, or what his or her true interests are. So if there were such a register, would people tell the truth?

Secrecy is so often the essence of power.

What would prevent fake transparency in declaring your interests?

Addressing Whealie‘s point, what if the Guardian were to try out an experiment in which commenters become part-owners of a section of the online newspaper and helped to decide on policies, including moderation?

There are serious gaps in the transparency of modern democracy. Between elections, the traditional mediators between electors and those in power have withered. The “customary associations and little platoons” have dwindled.

Spot-on.

But surely the press is that great traditional mediator?

Sorry, that was supposed to say, why is Simon opposed to restructuring the media for the 5th Estate? — far more democratic than the 4th Estate because of the greater inclusiveness of the internet as a medium.

Good analysis and fresh thinking — even if it is pessimistic.

That new art – made possible by the shift from the “society of producers” to the “society of consumers”, and from the meeting of capital and labour to the meeting of commodity and client as the principal source of “added value” – profit and accumulation consists mostly of the progressive commodification of life functions, market mediation in successive needs’ satisfaction and substituting desire for need in the role of the fly-wheel of the profit-aimed economy.

But couldn’t we use the internet to reverse that shift? It has given us so many tools to become producers ourselves – and to set up our own websites to sell what we make, anything from the materialist bits ‘n’ bobs that pass through E-Bay to paintings, texts, — even shares in creative enterprises of every kind, through so-called ‘crowd-sourcing’.

And what if the media were to lead the way — showing how to co-opt capitalism’s limitless energy and inventiveness through co-ownership? … effectively, a cross between socialism and capitalism?

Most of the new co-operative ventures tried in the 1970s failed, usually because decision-making was slow and cumbersome. But with the blazing speeds at which detailed information can be communicated and votes tallied with today’s media, new co-operative ventures wouldn’t be burdened with the same difficulties as the old ones.

Yes, there would be new problems – there are always problems – but why not experiment and see what happens?
